Terms of Service

These Terms of Service ("Terms") govern your use of esat.fyi and the other exam-preparation services operated by Percentile Labs (the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Who we are

The Services are provided by Percentile Labs, whose registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. In these Terms, "we", "our" and "us" mean Percentile Labs, and "you" means the person using the Services.

2. Eligibility and accounts

You must be at least 13 years old to use the Services, and if you are under 18 you confirm that a parent or guardian permits you to do so. You are responsible for the accuracy of the information you give us and for keeping your account secure. We use passwordless email sign-in, so keep access to your email account safe, and tell us promptly at [email protected] if you suspect unauthorised use. Accounts are personal to you and must not be shared. Note that tmua.fyi and esat.fyi use separate accounts, so your progress on one is not shared with the other.

3. Subscriptions, payment and refunds

Some features are free and others require a paid subscription. Prices are shown before you buy and include VAT where applicable. Paid subscriptions renew automatically at the end of each billing period unless you cancel beforehand, and you can cancel at any time from your billing settings, with cancellation taking effect at the end of the current period.

Where you have a legal right to cancel a purchase of digital content within 14 days, you acknowledge that by starting to use the paid features immediately you may lose that right once the content has been supplied. Nothing in these Terms affects your non-excludable rights under the Consumer Rights Act 2015. Except where the law requires otherwise, payments are non-refundable.

4. Acceptable use

You agree not to:

• use the Services for any unlawful, harmful, or fraudulent purpose;
• share, resell, or redistribute our content, or use it to build a competing product;
• copy, scrape, or bulk-download content, or use automated systems to access the Services, except as expressly permitted;
• attempt to reverse-engineer, disrupt, or gain unauthorised access to the Services;
• upload unlawful, infringing, or malicious content, or impersonate others.

5. Our content and intellectual property

The Services, and all software, text, questions, worked solutions, and design in them, are owned by Percentile Labs or our licensors and are protected by intellectual-property laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Services and their content for your own private study only. All rights not expressly granted are reserved.

6. Exam boards, universities, and independence

Percentile Labs is an independent provider. We are not affiliated with, endorsed by, or connected to UAT-UK, Pearson VUE, Cambridge Assessment, or any university or exam board. Names such as TMUA, ESAT, and university names are the trademarks of their respective owners and are used only to describe the exams and admissions they relate to.

Information we publish about admissions tests, university requirements, modules, dates, and scoring is provided in good faith for general guidance and can change. It is not official advice. You must always confirm the current requirements for your course on the official university and exam-board websites before you rely on them.

7. No guarantee of results

The Services are a study aid. We do not guarantee any particular exam score, admissions outcome, or result. Your performance depends on many factors outside our control.

8. Availability and changes

We aim to keep the Services available and accurate, but we provide them on an "as is" and "as available" basis. We may add, change, suspend, or withdraw features, and we may carry out maintenance that makes the Services temporarily unavailable.

9. Limitation of liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss, loss of profits, or loss of data, and our total liability to you arising from the Services in any 12-month period is limited to the greater of the amount you paid us in that period and 50 pounds.

10. Suspension and termination

We may suspend or end your access if you breach these Terms or use the Services in a way that could harm us or other users. You may stop using the Services and close your account at any time. Terms that by their nature should survive termination will do so.

11. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of the part of the UK in which you live.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you through the Services or by email. Continuing to use the Services after changes take effect means you accept the updated Terms.
